NOTICE OF PROPOSED APPLICATION FOR MATERIAL CHANGE

THE HINKLEY POINT C (NUCLEAR GENERATING STATION) ORDER 2013 (S.I. NO. 648)

Notice is hereby given that NNB Generation (HPC) Company Limited of 90 Whitfield Street, London, W1T 4EZ (“NNB GenCo”) (part of EDF Energy) intends to apply to the Secretary of State for Business, Energy and Industrial Strategy (BEIS) under Section 153 of the Planning Act 2008 (the “Act”) for a material change to the Hinkley Point C (Nuclear Generating Station) Order 2013 (S.I. No. 648).  This Order is a Development Consent Order (“DCO”) under the Act authorising the construction and operation of a new nuclear power station and associated development known as Hinkley Point C (“HPC”), located in Somerset.

The proposed application will request the removal of the requirement to install an Acoustic Fish Deterrent (“AFD”) system from the DCO.  The AFD system would be located approximately 3.3km offshore and was proposed as one of the mitigation measures to protect fish from HPC’s cooling water system.  An AFD system is located underwater and uses sound to deter fish with a sense of hearing from entering the cooling water system.  NNB GenCo will submit with its application, amongst other documents, detailed evidence demonstrating that removal of the AFD system will have no likely significant environmental effect on fish populations. The proposed change does not impact any onshore elements of HPC.

The DCO application was subject to Environmental Impact Assessment (“EIA”).  An updated EIA will be submitted in support of the application for a material change in due course.

Anyone who wishes to respond to the consultation in respect of the proposed application for a material change should make representations to NNB GenCo by e-mail to Hinkley-enquiries@edf-energy.com, by post to FREEPOST CONSULTATION RESPONSE or by telephone on 0800 169 6507 during normal office hours.

All responses must be received by NNB GenCo by no later than midnight on 4 June 2019.  All responses must state the grounds of the response or representation, indicate who is making the response or representation and give an address to which correspondence relating to the response or representation may be sent.  Please note that responses or other representations may be made public.

Please note that NNB GenCo has made a separate application to the Environment Agency to vary the water discharge activity (WDA) permit relating to HPC (EPR/HP3228XT) relating the removal of an acoustic fish deterrent system.  The Environment Agency are carrying out a separate consultation on that application.  Information on that consultation can be found on https://consult.environment-agency.gov.uk/psc/ta5-1ud-nnb-generation-company-hpc-limited-2. That website link is intended for comments to be raised on the WDA permit variation application only.
